Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://www.milkhoneykennels.com and the related pages, merchandise store, forms, applications, chat features, and other online services operated by Milk & Honey Kennels LLC (“Milk & Honey,” “we,” “us,” or “our”). By using the website, submitting an inquiry or application, communicating with us through an online feature, or placing a merchandise order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use these services.

A separately signed puppy purchase agreement, stud-service agreement, invoice, or other written contract may contain additional terms. If a separate written agreement conflicts with these Terms, that agreement controls for the subject it covers.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract to submit a puppy or stud-service application, place an order, pay a deposit, or otherwise enter into a transaction with us. If you use the website for another person or organization, you represent that you are authorized to bind that person or organization.

2. Website Information

We work to keep website information accurate and current, but puppy availability, litter timing, pricing, services, product details, and other content may change without notice. Website content is provided for general information and does not constitute veterinary, medical, legal, or financial advice. Images, descriptions, estimated adult traits, and similar information are illustrative and are not guarantees unless expressly included in a signed written agreement.

3. Puppy Applications, Inquiries, and Placements

  • Submitting a puppy application or inquiry is free and does not require a deposit.

  • An application is a request for consideration only. It does not reserve a puppy, guarantee approval, establish availability, or create a purchase contract.

  • You agree to provide complete and accurate information. Materially false or incomplete information may result in an application being declined or a placement being canceled, subject to any signed agreement and applicable law.

  • We may evaluate applications and placement fit in our reasonable discretion while complying with applicable law. Puppy availability can change until a placement is confirmed in writing.

  • No payment should be treated as an approved deposit unless we have first confirmed the payment request through an official Milk & Honey communication or invoice.

  • The applicable signed puppy agreement controls price, deposit terms, health guarantee, registration, breeding rights, pickup or delivery, transfer of ownership, and remedies. Statements outside that agreement do not modify it unless confirmed in writing by Milk & Honey.

Prospective and current owners are responsible for obtaining advice from a licensed veterinarian about breed suitability, health, nutrition, exercise, travel, and care.

4. Stud and Artificial Insemination Services

Stud and A.I. inquiries are nonbinding. Service eligibility, veterinary or reproductive requirements, collection or shipping arrangements, fees, timing, repeat-service terms, and any guarantees are governed only by the applicable written stud-service agreement or invoice. Reproductive outcomes cannot be guaranteed except to the limited extent expressly stated in a signed agreement.

5. Merchandise Orders

Our merchandise may be produced on demand by third-party fulfillment providers. Product colors, placement, sizing, and appearance may vary slightly because of screen settings, materials, manufacturing tolerances, and production methods. Prices, discounts, product options, and availability may change before an order is accepted.

By submitting an order, you authorize the applicable payment processor to charge the displayed total, including taxes and shipping when applicable. An automated confirmation acknowledges receipt of the order but does not require us to fulfill an order affected by an obvious pricing error, suspected fraud, or unavailable product. If we cannot accept an order after payment, we will cancel it and issue an appropriate refund.

6. Production, Shipping, and Delivery

Production and delivery dates are estimates, not guarantees. Delays may occur because of production volume, carrier operations, weather, incorrect address information, customs, or events outside our reasonable control. Customers are responsible for entering a complete and accurate shipping address and for any customs duties or import charges that apply. Please contact us promptly if an order appears lost, damaged, or incorrectly delivered so we can investigate with the fulfillment provider or carrier.

7. Merchandise Returns, Replacements, and Refunds

Please report merchandise that arrives damaged, defective, misprinted, or materially different from the order within 30 days after delivery. Include the order number and clear photographs of the product and packaging. If the issue is verified, we will provide an appropriate replacement or refund consistent with applicable law and the fulfillment provider’s policy.

Because most merchandise is made to order, returns or exchanges based solely on change of mind, an incorrectly selected size or color, or an address entered incorrectly by the customer generally are not accepted unless a product page states otherwise or applicable law requires a remedy. This section does not limit any non-waivable consumer rights.

8. Payments and Deposits

Merchandise payments are handled by third-party payment processors. We do not intentionally collect or store full payment-card numbers on our own systems. Puppy or service deposits and payments are governed by the applicable invoice and signed agreement. Refundability, transferability, and cancellation terms are determined by those documents, not by general website language.

9. Communications

When you provide contact information, you authorize us to respond through the method you requested or a method reasonably related to your inquiry, application, order, or service. We may use automated or AI-assisted tools to answer, route, transcribe, or summarize communications. Human review may occur when needed.

Providing a phone number does not by itself enroll you in recurring marketing text messages. Marketing emails or texts, if offered, are sent only as permitted by law and may be stopped using the unsubscribe instructions or by contacting us. Message and data rates may apply to text messages.

10. Acceptable Use

You may not misuse the website or services; interfere with their operation or security; attempt unauthorized access; submit unlawful, deceptive, abusive, threatening, defamatory, infringing, or malicious content; impersonate another person; use automated means to scrape or overload the site; or use our forms to send spam or fraudulent requests. We may restrict access or disregard submissions that violate these Terms.

11. Intellectual Property

The website and its original text, photographs, graphics, logos, mascot artwork, product designs, videos, and other content are owned by or licensed to Milk & Honey Kennels LLC and are protected by applicable intellectual-property laws. You may view and share links for personal, noncommercial use. You may not copy, reproduce, sell, modify, distribute, manufacture from, or exploit our content or designs without prior written permission. Third-party names, marks, and content remain the property of their respective owners.

12. Social Media and User-Submitted Content

Our website may link to social-media profiles or display social content. Activity on a third-party platform is also governed by that platform’s terms and policies. You retain ownership of content you submit. If you intentionally send or tag us in content for possible sharing, you represent that you have the right to do so and grant us a nonexclusive, royalty-free permission to display or repost that content in connection with Milk & Honey, subject to applicable law. You may ask us to stop future use by contacting us, although prior lawful uses may not always be reversible.

13. Third-Party Services and Links

We use or link to services provided by third parties, which may include Squarespace, Printify and print providers, payment processors, shipping carriers, application and form hosts, communications and automation providers, review services, and social-media platforms. We do not control third-party services and are not responsible for their independent content, availability, terms, or privacy practices. Your use of a third-party service may be subject to separate terms.

14. Disclaimers

To the fullest extent permitted by law, the website and general online services are provided “as is” and “as available.” We do not warrant that the website will be uninterrupted, error-free, or free from harmful components. Specific warranties relating to a puppy, stud service, or merchandise item are only those expressly stated in the applicable signed agreement, product policy, or non-waivable law.

15. Limitation of Liability

To the fullest extent permitted by law, Milk & Honey Kennels LLC and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from general use of the website or third-party services. For a merchandise claim, our aggregate liability will not exceed the amount paid for the affected order. These limitations do not apply where prohibited by law and do not replace remedies expressly provided in a signed puppy or service agreement.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Milk & Honey Kennels LLC harmless from third-party claims, losses, or reasonable expenses arising from your unlawful misuse of the website, your infringement of another person’s rights, or content you submit in violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. The parties will first attempt in good faith to resolve disputes directly. Nothing in these Terms limits rights or remedies that cannot lawfully be waived.

18. Changes to These Terms

We may update these Terms to reflect changes in our services, practices, or legal obligations. The revised version will be posted with a new effective date. Changes apply prospectively unless applicable law requires otherwise. Continued use after the effective date constitutes acceptance of the revised Terms.

19. Severability and No Waiver

If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law. A failure to enforce a provision once is not a waiver of the right to enforce it later.
